One of the biggest problems facing consumers who purchase a used automobile is the “as is” sale. However, while some dealers print on the buyer’s guide, “as is – no warranty – you will pay all costs for repairs”, an unsophisticated buyer may conclude that the dealer won’t pay to fix but that the car will function reasonably well and be free of major defects. Also, a key exception to the “as is” sale is a claim for fraudulent misrepresentation. For example, if the salesman make statements giving a false impression of the car’s condition or actively conceals a known and hidden defect then the buyer may have a potential claim for fraudulent misrepresentation.
